These general terms and conditions (hereinafter: Terms and Conditions) apply to all quotations issued by The Headhunter Group B.V. (The Headhunter Group) to the other party (hereinafter: the Client), all Agreements entered into between The Headhunter Group and the Client (hereinafter: the Parties and each individually the Party), as well as all future agreements entered into between the Parties and all other contractual relationships and assignments insofar as relating to the following activities:
These Terms and Conditions consist of three chapters, a general chapter that applies to all activities of The Headhunter Group. The chapter that follows is additionally applicable to the activity regarding the temporary recruitment of Interim-Managers. Finally the third chapter applies additionally to the permanent recruitment activity. These Terms and Conditions are a translation of the Dutch Terms and Conditions. In case of any inconsistency between this version and the Dutch version, the latter will prevail.
In addition to Chapter I, the terms and conditions of this chapter apply if the Client make uses of The Headhunter Group’s permanent recruitment activities. In case of discrepancies between Chapter I and this Chapter, the latter will prevail.
1. Assignment
1.1 The Headhunter Group will document the Client’s relevant vacancy as much as reasonably possible through a job specification or otherwise. E.g. it may contain the job description, the required qualifications (including degrees and capabilities) as well as the selection criteria.
1.2 The Headhunter Group will procure its reasonable efforts to introduce one or more Candidates. If The Headhunter Group fails to do so, it will not be liable to compensate any damages to the Client.
2. Payment Permanent Recruitment
2.1 For its permanent recruitment services, the Client shall owe to The Headhunter Group the fee mentioned below as soon as the Client directly or indirectly enters into an agreement of whatever nature with the Candidate.

≥ €100.000.- 30,5%
2.2 If the Client withdraws, cancels or changes essential parts of the Agreement, any costs incurred until such date, such as the Candidate’s travel and accommodation costs and advertisement costs will be charged to the Client. The Client is deemed to have changed essential parts of Agreement if it has changed elements thereof which in The Headhunter Group’s opinion create a new assignment.
2.3 The Headhunter Group will restart its search for a new Candidate without any additional fee or costs (with the exception of costs of advertising which will be submitted for approval to the Client in advance ) if the employment agreement between the Candidate and the Client is terminated within one month after its starting date, provided that:
